Tractor Trailer Accident Prompts Swift Transportation Lawsuit

A serious tractor trailer accident has prompted a Mississippi man to file a lawsuit against Swift Transportation and other associated parties due to allegations of negligence.

The tractor trailer accident lawsuit claims that in December 2015 plaintiff Willie M. was a passenger in an 18-wheeler owned by the Swift Transportation Company. According to the lawsuit, the driver of the truck failed to travel within a single lane while going into a construction zone, causing the tractor trailer to go out of the lane and strike the left guardrail.

At that time, the tractor trailer rolled onto the side of the driver and stopped shortly below the railroad tracks.

The railroad tracks were shifted as a result of the accident and the plaintiff was ultimately ejected from the tractor trailer.

The driver who allegedly caused the accident, is deceased. Therefore, the lawsuit is filed against the administrator of his estate. Other defendants include Ace American Insurance Company and Swift Transportation Company of Arizona LLC.

According to the tractor trailer accident lawsuit, the defendant driver of the truck was negligent because he failed to keep an appropriate lookout, failed to control the speed of the vehicle, failed to maintain proper control of the vehicle, failed to make a timely and proper application of the brakes and was driving the vehicle with a wanton or willful disregard for the safety of persons or property.

The lawsuit is pursuing compensation on behalf of the injured victim’s physical pain and suffering, lost wages, attorney’s fees and emotional distress. The tractor trailer accident lawsuit further claims that Swift Transportation Company was responsible for hiring, training, supervising and retaining competent employees and to regularly inspect the driving records of the defendant prior to hiring him or her.
